Successful Appeal for Trust Fund Tax Abatement

Hamernik, L.L.C. recently learned that its IRS appeal for $1.364 million in trust fund taxes is successful and taxes are abated. The Firm was first contacted by the company upon its receipt of tax notices for non-payment and defaults with its existing lender. Hamernik assessed priority #1 to engage the lender and negotiate terms to ensure continued funding and cash flow, which were leveraged in meeting with the IRS. The IRS agreed to an interim installment plan with minimal payments and requirements to remain current. The Firm introduced outside payroll processors to ensure compliance, then turned to operational issues with management. Past due taxes were assessed and Hamernik prepared an appeal on behalf of the officer. After months of negotiations, the entire tax was abated.
